The LCA process is the same for every state, under the new iCert LCA system. Approval can take 2 weeks, or longer if DOL does not recognize the EIN, which is very common.

I am working for Company A on a full time basis on H1B and part-time with Company B(non-profit) on a concurrent H1B. I filed for my GC with Company A and I-140 is approved and applied for I-485 and got EAD/AP also.
My H1B with Company B is expiring and the 6 year term will end on December 31, 2009. I am planning to apply for H1B extension for this H1B and the company attorney says I can get it extended based on Company A I-140 because it is a concurrent H1B. How far is this true? Can I extend my Company B H1B based on the approval on Company A H1B?

sorry to break it to you - but he's quitting a very happy man as every other rupublican is trying to 'out-tancredo tancredo' as he himself put it. he's done his job and poisoned the atmosphere which is all he wanted to do.
I disagree . He thought his immigration stance will take him to white house. He earlier announced that he will not run for congress again. Poison can be taken care of as long as you kill the snake so that it does not bite other people.

The CIS estimates have proven to be very high resulting in: 1) the �unavailability� of all Employment Third preference categories beginning in July, 2) the �unavailability� of numbers for China and India Employment Second preference adjustment of status cases during September, and 3) the establishment of many October Employment cut-off dates which are earlier than those which applied during FY-2008.
Little if any forward movement of the cut-off dates in most Employment categories is likely until the extent of the CIS backlog of old priority dates can be determined. It is estimated that the FY-2009 Employment-based annual limit will be very close to the 140,000 minimum.

If it is by and large the same business, their immigration lawyer will have to file some paperwork indicating the company has changed its structure and for the paperwork to be amend under the new name.

One of my minor dependents appears to have been out of status due to non renewal of their H4 visa. We thought that like the original application, dependents were covered by my renewal, found out too late that this is incorrect. Since then we have obtained renewals and the dependent in question now has an approved H-4 status, plus pending 485 and advanced parole.
I have been told though that time out of status is not counted against minors. Is this true?
Is there any risk in travelling out of the country to get visa stamped and returning? I understand this resets the clock. Can the embassy look into the history, find out that previous issue and deny the H-4 stamping because of it?
I am very discouraged by this long drawn out process. Any information would be appreciated.
PS: The minor in question just turned 14 years old. Could this be the reason?

Washington: With the arrest of seven Indians, U.S. authorities have claimed to have busted an immigration racket run by an information technology company owner who charged tens of thousands of dollars from expatriates by fraudulently sponsoring their H-1B work visas.
Nilesh Dasondi, 41, was arrested last week on multiple counts of visa fraud involving Cygate Software and Consulting Inc. which run offices in India and Canada.
A naturalised U.S. citizen, Dasondi, also a member of the Edison township board in New Jersey, was released after posting a $8,00,000 bail but he must remain under home confinement with electronic monitoring.
According to court papers cited in Newsday daily, Dasondi is accused of filing federal work visa and immigration documents for six people who did not work for his company between 2003 and 2007, the authorities said.
All the six have been arrested. In exchange, they made payments of more than $8,50,000.
The money was used to support phoney payroll disbursements back to the people, fund tax payments and, in some cases, pay for health insurance, authorities said. Dasondi, however, kept for himself the remainder of the cash after the so-called �running the payroll� scheme. Three bank accounts in the name of Cygate were seized. A fourth account in the name of another company Dasondi controlled was also frozen.
Among those arrested were Kishor Parikh (42), Devang Patel (31) and Chetan Trivedi (40). � PTI
