My I-140 is also pending in Nebraska, I am also in EB-3 category with labor PD 02/20/2007. Your labor PD is 03/2007 and hence it is surprising! I saw an approval for one EB-3 filed in April 2007 in but his PD is 2002.
I do not see any LUD these days in my pending I-140 and I-485. There was a soft LUD in my wife's I-765 (EAD already approved and received) about a month back.
Please keep us updated.

To best of my knowledge, a person on EAD (probably not the primary candidate) can work for anyone.. It can be City, State, Federal or McDonald's at any position, part time or full time, provided the job does not involve any government classified information. Jobs involving classified information are only for citizens that too after proper background check.
Primary candidate might work for the government i.e. if job requires skills that citizens don't have and that group has a policy of filing H1's..

IV seems to have a lot of folks here on a h1b with a non profit organization. My wife is currently doing her residency in a non profit organization on a h1b so basically she is not subject to the cap.
After she finishes, and she looks for jobs, is it possible to get a h1b transfer in a profit organization without being subject to cap? Or H1b transfer is possible only with an non profit organization.
Any inputs will be well appreciated.

Hi,
My I140 got denied early this year and the appeal is pending. Processing times for the appeal is 22 months. My priority date will be current next month. Because of that i am considering to refile my I140 and 485 again and withdraw the appeal.
1) Can we refile I140 with the same category (EB2)
2) Can USCIS just deny the new I140 because of the earrlier denial
3) Is there any one who tried this. What is the outcome of the new I140 application.
Please share your experience and also please advice

I think it is not the company but the service provider's gateway address. This usually happens in Iselin, Edison - NJ areas where there is a huge concentration of immigrants. USCIS is probably tracking and blocking the IPs.

It is possible to "interfile" in this situation, (See AFM Sec. 23.2(l) Transferring an Adjustment of Status Application from One Underlying Eligibility Basis to Another).
However, I do not think you can successfully interfile until your wife's 2010 PD is current. ( See AFM Sec. 23.2(l)(2)(L) The Priority Date must Be Current for the Basis to Which the Applicant Wishes to Convert).

Do any of you received finger prints notice who has E-Filed EAD renewal between June 25th - June 30th.
We filed on June 29th with Texas Service Center and it's been a month we are waiting for FP notice.

Does anyone have any insights or theories on why PERM processing is so badly delayed at Atlanta? And why are applications being processed out of order? People who filed in Jan 06 are getting approved while those who with priority dates in 2005 are still waiting. Does anybody have ANY idea? There should be some transparency in the process. It's just a black box right now and that makes the process ten times more frustrating.

My Case Details:
I currently have an H1 and have applied for 485(in July 2007, EB3 India, priority date April 2004, I-140 Approved, EAD approved). My wife also applied 485 (as beneficiary dependent) along with me and is currently working on EAD. Unfortunately my daughter was not in the country in July 2007 and due to unavoidable reasons she was not able to apply for 485 then. She came to US on H4 dependent visa and is currently studying in public school.
My H1B visa and my daughters H4 visa expires in Sept, 2010. I want to use my EAD in case if my H1B extension is not approved in Sept, 2010 and am trying to find out if there were other legal ways for me to have my daughter documented in US.
One of the option I was considering is try to get a F1 Student visa for her. My Daughter is in 10th grade currently (15 years old).
Please advice:
- What would be the best independent status for my daughter ?
- if My daughter converts to a student visa (F1), and some time later EB3 category becomes current for my priority date, then can 485 be applied for my daughter while she is in F1 status ? IN other words are there any issues of her being in non-immigrant intent F1 visa and me applying for 485 for her as my dependent ?
- Is there any limit on the number of years a person can be on F1 Visa in US ? She is currently in 10th grade and might join 11th Grade in F1 visa.
- Does she need to go out of US to change her status from H4 to F1 ?
- In case if required can I convert my EAD status back to H1B ?

I applied for my Certifcate of Citizenship through my US citizen father about 5 years ago, and due to that US citizen father being an ass I still don't have it.
I have decided to just go back to England. I am happy about going back now and this post isn't about finding other ways of getting my citizenship.
When I originally came to the US I intended just to visit so I came on the Visa Waiver Program, and then decided to stay and become a citizen
My query is: When I leave to go back home will I be able to leave the US with just my passport(recently renewed) and ticket? or will I have to contact the USCIS and get some kind of letter or the like?

You do not need any agency's permission to leave US. Just submit the I-94 form if you have one.

Yes, She can stay legally. There can be some minor complications if she needs travel out of USA after Dec 20 but before extension is granted.

We filed for adjustment of Status in August 2006 and received EAd's and travel documents. We have not yet received fingerprint dates. Will it take this long? Any advise on how to deal with this?
