There are still some new members who keep posting that the bill S 1348 looks very good and it has SKIL provisions etc, because they get pointed to the last year's bill.
If you go on thomas.loc.gov and find bill text for S. 1348 you see a bill that is a copy-paste version of LAST YEAR'S SENATE BILL S. 2611.
That text is last years text that was initially put in place as a place-holder BEFORE the grand compromise was reached.
After the grand bargin (compromise/coalition) was reached, the text of the grand compromise replaced the entire text of last year's bill (that has SKIL) was the next text.
Amendment # 1150 (S.A. 1150) Sponsored by Sen. Kennedy is a 400 page amendment that replaces the entire text that was intially in the bill with the new text. Its a "Substitute" amendment.

It depends on how many cases that will be pending approval on October after the surge of applications this July and August.
I think it wouldn't be current for some countries specifically India and China.

I am planning to own a franchise on EAD along with my friend who is on H-1b. Please let me know if I can do it or not.
We are planning to register a LLC and run the franchise on the company. Let me know if I have to take any precautions before buying the franchise..
Also let me know if my friend can be my partner on H1.b..
You can own and work for your LLC. Your H1b friend can be a partner, but he cannot work for the LLC, he can have his share of profits though. You need to confirm this with a lawyer before you register your LLC.

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Thanks in advance for your response."

I'm going to Vancouver for H1B stamping next week along with my spouse. My understanding is that $150 is the application fee but I'm not sure if it is $150 for entire application (H1 + H4) or is it $300 ($150 for myself and $150 for my wife).

Both I94, one you got at POE and another you got from H1 approval notice has same number. I94 attached with the H1 approval notice has expiration date and you can use it until it expires. I assume, both are valid since both has the same number except the expiration date.

Hi Guys,
I am working with company A on H1B, currently on bench (no pay, all vacation used up) and no pay stub. I got an from offer from Company B and have started the H1 transfer process. I would like to know how soon can I join company B. My friend says I can join as soon as USCIS receives the H1B application i.e. as soon as the fedex delivery reciept becomes available I can join the company B.
The lawyer from company B says I need to wait till a reciept notice is received from USCIS.
Who is right? I want to believe the lawyer for obvious reasons (she is a lawyer) but my friend did the similar thing, he joined the day his app was received at USCIS and he was adviced so by his company's lawyer.
A rationale to join on the same day is that when the H1 is approved it will have the start date same as the day USCIS received the app (as that is the requested start date of transfer).
I'd appreciate your inputs.

My wife did her MBA and used her OPT before marriage. After a gap of OPT period she again went to school and got a MS degree. During her OPT, she did not work at all. Now she is unable to get second OPT for her recent MS degree.
Is there a way out to get second OPT? Can this new law (29 months OPT) if passed, be used to apply for second OPT.
What should be best approach? Please advice.

Me and my wife received our EADs and our H1/H4 is valid till 2010.
My wife is attending school being on H4. Since she has EAD, can she work part time(not in school) and keep the H4 status valid.

We went for FP today and my wife had henna on her hands. I was concerned about it but it never was an issue. The FP went as if she had nothing on her hands instead the FP people pleasently talked abt henna.
We went to the Atlanta office, the staff was pleasent, work flow streamlined and we were done in less than an hour although they looked and checked our hands almost four times for bandages and cuts.
