Has anyone been in a situation where they joined a new employer after having completed 180 days after 485-filing, and sent in AC-21 documentation through an attorney?
If so, which attorney did you choose for the AC-21 paperwork?
- The old attorney, that represented you and your ex-employer, and filed your labor, 140, 485, EAD, AP
- or the attorney representing the new company
- or a third attorney that you went and found on your own
What do you think is the best way to go, if there is a best way to go?

I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

Recently my 140 was filed and the checks were cashed through ACH. I paid for PP and see that the checks were cashed on March 8th. My attorney has not received my receipt, I was wondering if there was anyway I can get the receipt number for the case so I can track it ...

I was checking the http://congress.org
I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.
Any thoughts........

I am EB3 - Dec 2004 filer and there is no hope for few years that my date get current. i have filed another GC through my sister in May 2006 and that F4 category is moving quicker and expecting my priority date will be current in 5 years through my sister.
i have bought 2 Family house in Jersey City. now for my kids education we thought to move to India for 4 to 5 years until we get call for GC though my sister.
we are going to rent house - it's multi family near NYC. my landloard is willing to take care of it in our absence.
my Q is can we get B1 (Visitor visa) for 10 years , if we show that we have property in US and we may need to visit just to take check it ??
should we inform immigration officer about GC filed though my sister to assure that we will not stay in US longer, to get B1 visa?
can we get visitor visa before leaving USA? i mean converting from H1 to B1 for multi year?
i would appreciate some suggestions.

You need to have an 1-485 application in at least for six months before using portability.
You can contact a body shopper and ask them to file I-140 and use your current priority date.
There is nothing else possible if you are already at your sixth year of H1B.

Sir/Mam,
I am was in US on H4. I am currently in my home country for vacation.
While here, I got my H1B applied and approved as consular processing for 2011 cap.
I plan to go back to US in August on H4 and then apply COS in October and start working.
My question is : Since my H1 was approved while I was out of US, will my COS also be approved as consular processing only? Do I have to go for stamping again before I could start working???
Also, if I decide to wait and get my H1 stamped in my home country, what is the earliest I can go to stamping for 2011 cap? Can I land in US on H1B sometime mid September and start working from October.

I have filed for the 7nth year extension based on my pending labor (365 days old). The perm is picked up for an audit. Incase if the perm is denied, will h1b also be rejected ?
As per my understanding, your H1 will not be denied but you will not be eligible for any subsequent extensions unless at that time you have one more perm pending for over 1 yr or I-140 approved.
I would recommend you find another employer or file perm through some one else as future employee. 30% perms in audit are denied after 2 yrs wait.
