    If you're worried, the easiest thing to do is to have the name changed in the passport. The Consulate doesn't ask for any questions and issues the new passport within a day. For my friend, the first name and the last name were interchanged and getting the new passport was a breeze.

    So, u mean have to go to the consulate and get it done........ i dont think right now can take a chance of sending the passport to the consulate............. thnaks for your advice, will def. check with the consulate........

    Just an observation - There always seem to be a gap of 2 months between Receipt date and Notice date.

    So for July 2nd filers, there notice date would be September 2007. But they all got GC last yr when they made it current till 2006 PD. However processing times arent Sept 2007 even now which makes me believe its the receipt date?

    What do you guys think.

    Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact others basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damege or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.

    Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.

    Bill Clinton did a wonderful fix by signing AC21 which corrected many shortfalls of immigration law.

    I am personally not impacted by backlog. However, I am feeling bad enough for the failure of current sysem that overlooks human tragedies. 180-day name check fix is a commendable step by USCIS (brought about by healthy debate and do not look at this as court-imposed). As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.

    If there is any way to open up annual quota (recapture, family members exempt from annual limit or any measure I am not aware of), automatically everybody could benefit. It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. there is ot a magic wand. We could help our administrators, law makers and law protectors and law upholders to make appropriate corrections. Hence, scientific and rational dialogue through fair and just means is our focus.

    Let us highlight our difficulties in a logical way. Go about living normal life but stand up for something you believe in.

    Honestly, Ineed to do some research on EB3 situation and see if there is something more meaningful to share with IVians.

    I would not believe on hearsy and rumors. It can only be verified after talking to USCIS top officials.

    I totally agree. This might be true, but cableching MUST update his profile with a valid information and be verifiable and then be contacted if we want to believe what he says.

    As many are aware, there was a huge rush to buy and sell pre-approved labors during July-August 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable GC seekers, who hadn�t even started the process till then.

    It is those substituted labors which are clogging the pipelines now. Just think, last month EB3-I stood at November 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that GC process alive. In all likelihood he/she must have moved on in life.

    There is only one explanation. These labors were already pre-approved. It is the attached I-140 on these labors that are getting approved rapidly. And the subsequent I-485 petitions on these applications are depleting the visa numbers.

    The reason of this post is not to start an argument about the ethics of labor substitution. It is just a FYI post to explain the seemingly inexplicable. The chickens are coming home to roost.

    Not completely agreed. Same as people filed in EB2 - no more qualified just better luck that their employers agreed and job description fit with EB2. Unlucky people like me got into EB3. I say EB2 are clogging....

    This will take us to nowhere. Lets concentrate on something positive like recapture.

    You said that you are from the Midwest, but your profile says that you send your application to Texas. How is that possible, All midwest I-485 applications must have gone to Nebraska Service Center.


    "I am in Midwest and not all the USCIS/ASC offices treat as bad, as these guys may not have that many applicants coming to the office, like int Northeast or California."



    I really don't understand why people think I am lying????
    When I read the memo, I was more worried about my name check and whether she would check the status of it than about this, as anyhow my dates are not current. After showing the memo, she did offer to check the status.

    With all the experience our guys have with USCIS officers and staff, it's hard to belive an IO would be that helpful? But, she's and even the staff at this office is not as bad as others have experienced.

    I was even telling my wife about the behaviour and how staff at other offices behave.

    A lot of people have already sent the flowers and they do not follow the IV nor do they care about polling here.
    I think the idea is catching up very fast thru email chains and people are doing this independently
    So we will never know, exactly how many people really sent the flower, but still the effect is the same !!!

    A well framed lawsuit forcing the USCIS to disclose how many I-485 cases are pending (approvable or not) listed by
    EB category
    applicant's nationality
    estimated priority date

    USCIS can easily generate that report without spending much effort.

    Sure it will not get us the GCs sooner, but it will help us plan our lives much better, it will take lessen the uncertainty.

    If we can get a group of US citizens or permanent residents or employers to file this suit it will be great . I think it will work.

    It is easier to get information from someone than to get them to do something.

    donated $50; learned about the organization on June 8, participated in the event - not knowing any of the issues. Was an eye opener to the legislative process. I did not do much, just accompanied the IV members to the meetings - these members were well prepared to present the case as well as to answer questions. I am impressed, and here I am registered and donated.

    The USCIS published this information as part of its compliance with the Privacy Act. Understanding this information is helpful to the immigration stakeholders, immigrants, nonimmigrants, and related parties in handling immigratiopn benefits applications.
    Benefits Information System: The DHS is managing the following computer information system relating the immigrant and nonimmigrant processings: SORN: CLAIMS 3, CLAIMS 4, the Redesigned Naturalization Application Casework System (RNACS); the Citizenship and Immigration Services Centralized Oracle Repository (CISCOR), the Interim Case Management System (ICMS), Integrated Voice Response System (IVRS), and the Integrated Card Production System (ICPS).
    Purposes and Uses of the Information System: The records and information in the system broadly serves three purposes: (1) Automatic access and retrieval in immiration benefits and naturalization applications processing and adjudication for efficiency and fraud detections. (2) National and homeland security. (3) Information sharing with local, state, and federal law enforcement agencies or other government and private entities within the parameters of the Privacy Act of the country. As for the purpose of achievement of efficiency of immigration benefits processing and adjudications, the system assists in the automated processing of f immigrant and nonimmigrant benefit petitions and applications. Both investigative and administrative records are maintained in this system to permit USCIS to function efficiently. Reports are also generated from the data within the system of records. This system of records notice enables DHS/USCIS to provide automated support to process applications and/or petitions for benefits; determine the status of pending applications and/or petitions for benefits; account for and control the receipt and disposition of any fees and refunds collected; conduct searches pursuant to FOIA and Privacy Act requests; and locate related physical and automated files to support DHS/USCIS responses to inquiries about these records.
    Categories Individuals Covered: Persons who have filed (for themselves or on the behalf of others) applications or petitions for immigration benefits (other than asylum and refugee) under the Immigration and Nationality Act, as amended, and/or who have submitted fee payments or received refunds from such applications or petitions; current, former and potential (e.g., fianc[eacute]) family members of applicants/petitioners; persons who complete immigration forms for applicants and petitioners (e.g., attorneys, form preparers); name of applicant's employer; and individuals who seek access to records retained in the Benefits Information System under the Freedom of Information/Privacy Acts (FOIA/PA).

    Categories of Records in the System:
    Individual's name;
    Social Security Number (if applicable);
    A-Number (if applicable);
    Addresses;
    Telephone numbers;
    Birth and death information;
    Citizenship or nationality;
    Immigration status;
    Marital and family status;
    Personal characteristics (e.g., height and weight);
    Records regarding tax payment and financial matters;

    Record and Information Safeguards: Records in this system are safeguarded in accordance with applicable rules and policies, including all applicable DHS automated system security access policies. Access to the computer system containing the records in this system is limited to those individuals who have a need to know the information

    That validates my reply previously to a posting by a guy who said that he had called up TSC and they said they go by RD...I had asked him to call back after a day and he'd get totally opposite info.

    My situation is the same.....I was TSC-CSC-TSC....but I had received an RFE last year.....dunno why will they preadjudicate and then go by ND which is totally non-sense...logic should be that if a case is preadjudicated it should be put on based on PD..

    Again USCIS don't follow any logic...

    As I said b4 very few transfer cases will ever get approved.....just bid your time...or apply thru EB1 chances are better that way..

    How about someone answer this?

    TSC current processing date is August 30th 2007. One yr ago, it was in July 2007 or something. July 2nd filers in 2007 would have had their receipt date as July 2nd and ND like September 2007. If they used ND, its not in their processing zone. So how did they do it?

    So yes, its all bs as far as USCIS is concerned. They are govt employees for God's sake.

    Except for those still living in denial, we know that if anyone actually "DID" anything to cause the reversal of July Visa Bulletin... it was Hon. Congresswoman Zoe Lofgren, Ms Gabriela Ptasinska who filed a lawsuit from Chicago, and Immigration Voice!

    Now,
    1) Calculate the amount of money YOU saved by not having to re-apply for your and your family's AOS under the new fee structure (and who knows after how many years into future?)
    2) Look at the amount of money your spouse can now bring home as he/she is eligible to work with their EAD
    3) Add the medical examination fees
    4) Add money you would spend on photocopies/ courier charges/ driving to your lawyers office to sign the papers

    The list is long, and all of it is now part of your "savings" largely due to the efforts of Immigration Voice!

    And even after saving so many $$, people think $50 a month is too much to ask for?? And that too, when this is going to help bring you even closer to the one document that you think about everyday?

    That sounds like "penny wise pound foolish"!

    It's not too late, please sign up for monthly contributions and get active... and help IV to help you see your Green Card sooner than later.

    This is a very great idea, and I think with the aggresive efforts and campaign we can achieve this as we have achieved Julye'07 I485 filling and 2yr. EAD solution, let's discuss and have action plan on how to move forward on this matter, united we can achieve this.
